MOUNT STREET

This indenture, made the 28th January in the year of our Lord 1846 between Francis Paynter, in the town of Penzance in the county of Cornwall, gentleman of the one part, and William Corin of the parish of Gulval, in the said county, farmer on the other part That in consideration of the said William Corin covenanting to build and complete a messuage or dwelling house on the plot of ground herein after demised and of the yearly rent and offer payments He the said Francis Paynter hath directed limited and appointed granted demised and leased and by these present Doth direct limit and appoint grant demise and lease unto the said William Corin his executers administrators and assigns that plot of land, part of certain fields called the Leskinnick Fields in the town of Penzance Aforesaid containing by measurement at the front and back thereof sixteen feet and --------- feet in depth and is bounded on the east by Mount Street and on the west by a back road thereof ten feet, on the north by other part of said fields, and on the south by a dwelling house lately built by Thomas Tredrea. Together with the said messuage or dwelling house so to be erected against the northern wall of the said dwelling house when completed as aforesaid and the northern wall of the courtyard thereof all minerals and metals within or under the same premises with the accustomed right of digging for working and conveying away the same. And also accepting all the timber trees and saplings to grow in or upon the said demised premises. William Corin now aged about twenty eight years, Sarah his wife now aged about twenty one years and Thomas John Tredrea, son of William Tredrea of Chyandour in the said parish of Gulval, Innkeeper, now aged nine years ------- or either of them shall so long happen to live. Yielding and paying the yearly rent or sum of Twelve Shillings of lawful English money at Lady Day, Midsummer, Michaelmas and Christmas Day in every year by equal quarterly payment thereof to be made on Ladyday next. And also yielding and paying unto the said Francis Paynter the sum of Ten Shillings and Sixpence as a Heriot on the death of the said lives. And the said William Corin doth hereby shall and forthwith erect and complete a substantial messuage or dwelling house on the said plot of ground hereby demised with (fine ?) and durable materials of the best quality and in line with and corresponding in exterior to the said dwelling house of the said Thomas Tredrea. And also shall and will pay the said Francis Paynter the said yearly rent . And also shall sufficiently repair the dwelling house and premises when built and completed and every part thereof as well in walls roofs doors floors windows partitions ceilings and sewers as in all other reparations and amendments whatsoever. And the same in good repair shall and will at the end or other sooner determination of the said term quietly and peaceably leave and yield up and also shall and will permit the said Francis Paynter any persons deputed by him to enter into the premises hereby demised to examine the state of repair and condition thereof and shall not at any time during the said term carry on or suffer to be carry on in or upon the said premises hereby demised any noxious or offensive trade, business or calling which shall be or grow to the annoyance of any of the other tenants for the time being of any of the other Messuages or dwelling houses already erected or hereafter to be erected on the other parts of the said fields and that the said William Corin, executors, administrators or assigns shall at any time and so from time to time hereafter upon every (notice)to be delivered to him or them or left on the said demised premises give or cause to be given to the said Francis Paynter his heirs and assigns and the person or persons entitled as aforesaid within six months offer any and every such notice indisputable proof that the person or persons herein named as the life or lives is or are respectively alive and where he or she or they was or were respectively alive and where he, she or they was or were respectively abiding at or about the time of such notice given and in case the last or only life can not be proved to be alive within the six months after notice given as aforesaid then shall and will peaceably and quietly yield up the said premises hereby demised to the said Francis Paynter his heirs and assigns or the person or persons entitled as aforesaid and pay unto him or them the approved yearly rent of the said hereby demised premises for the time the said William Corin his executors administrators or assigns shall hold and continue to occupy the said premises after such life can be deemed to be dead. and further that he and the said William Corrin his Executors and Administrators or Assigns shall at his or their own proper costs and charges forthwith and during the continuence of the town hereby greater insure and some good and sufficient Insurance Office in London in the joint names of the said Francis Paynter his heirs and assigns or the person or persons entitled as aforesaid and the said William Corin his Executors and Administrators and Assigns the said hereby demised premises in the sum of One Hundred Pounds against casualties by fire in order in such case the due laying out of the same in or towards the re-erection of the said premises and also will after reasonable notice amend and do suite and service at all and every the Court Courter of the said Francis Paynter his Heirs and Assigns and the person or persons entitled aforesaid to be held for or in respect of His lands inPenzance afforesaid and where thereunto appointed perform the office of Reeve for the same lands or pay Three Shillings and Six Pence for every default And if it shall happen that the said yearly rent and Heriots thereof respectively shall be unpaid for Twenty Days next after the said times of payment whereon the same ought to be paid being lawfully demanded or if the said William Corin his Executors, Administrators or Assigns shall suffer the said demised premises or the said Messuage or dwelling house or other erection when completed or afforesaid to be in decay to the value of Forty Shillings or more and and the same shall not sufficiently repair within two months next after notice to him or then given or left on the said demised premises or shall choke, dam, or otherwise prevent the free vent into and from the Common Sewer of the several present or future Leases of the said Francis Paynter his heirs and Assigns which passes through or shall be found necessary at any time hereafter to pass through the said demised premises or shall do or commit any act, mather or title or estate of the said Francis Paynter his heirs or assigns or the person or persons entitled to afforesaid in the same premises or in breach of any or either of the contents herein contained That then and from thenceforth it shall be and be lawfull for the said Francis Paynter his heirs and assigns and the person or persons entitled as aforesaid in the said premises and in breach of any or either of the covenant herein contained That then and from thenceforth it shall be and be lawfull for the said Francis Paynter his heirs and assigns or the person or persons entitled asaforesaid in the said premises and in in breach of any or either of the Covenants herein contained That then and thenceforth it shall be lawfull for the said Francis Paynter His heirs and assigns or the person or persons entitled as aforesaid into the said hereby demised premises to entoo and the same from henceforth to have and enjoy as in his or their former Estate and right And Lastly the said Francis Paynter doth hereby and for himself and Heirs and Assigns and the person or persons entitled as aforesaid covenants and agree with the said William Corin his Executives, Administrators or Assigns shall be desireous of taking a further lease of the said premises hereby demised under the terms herein after mentioned he the said Francis Paynter his heirs and assigns or the person or persons entitled as aforesaid shall at the expence of the said William Corin his Executors, Administrators or Assigns when either one of the persons above named as lived in their lease shall first die and within the six months next after such death and not otherwise and in consideration of the sum of Eight Pounds and Eight Shillings Sterling to be paid to the said FrancisPaynter his heirs and Assigns or the person or persons entitled as aforesaid and upon a **oviender of this present lease grant and execute a new lease to be prepared by the Attorney for the time being of the said William Corin his executors and Administrators and Assigns for the residue of the said term of ninety nine years to be determinable on the death of the then two subsishing lives named in the lease and of such other life of the said William Corin his Executors, Administrators and Assigns shall then name in the room of the life so dying under the like yearly rent and reservations, exceptions, covenants and agrements as are herein contained so far as the nature of the circumstances will then permit and particularly with a covenent similar to this in such Reversionary Lease so to be thereafter granted as aforesaid for renewal of such last mensioned lease to the then residue of the said term of nine years upon the death of such one of the several persons therein named as lives as shall first die provided such last mensioned renewal be applied for with six months next after such death as aforesaid and upon payment of the like sum of Eight Pounds and Eight shillings and with the same covenants as are herein contained except the covenant for the renewal which is not to be inserted in the Lease to be secondly hereafter granted as aforesaid ~ IN WITNESS whereof the said parties to these presents legally stamped their hands and seals have set the day and year first above written.
